Our client was sued twice by Cavalry SPV I, LLC for $2598.80 on a credit card he once had with HSBC. The card had, allegedly, been transferred to Capital One Bank, N.A. at some point, and then to Cavalry SPV I, LLC. Cavalry SPV I, LLC then sued my client. He answered the complaint pro se (after having read my book) and then hired me to come to trial for him. I notified the collection attorneys of my appearance in the case and requested copies of their evidence. We were able to convince the judge to exclude their evidence from the record and rule in our favor.
The case was heard in the District Court of Mobile County, Alabama. The debt, if it ever existed, must now be permanently removed from my client’s credit reports. Another victory for Alabama working folks!

I am in Chicago. I just saw on the Cook county clerk page that they are trying to sue me for a Capital one charge card. Right now the status is:
SUMMONS RETURNED – N.S. REASON: NOT LISTED
Any advice on which route to take? Seems like you know Calvary very well and have had success. If you think you could help me or guide me in the right direction I would l gladly pay for your consulting.
The amount they are suing me for is Amount: $3462.06
I may try to go pro se. But would pay you for a brief consulting on how to attack this. Maybe there are mistakes or procedures you are aware that Calvary misses?
thanks

Kev,
I have dealt with Cavalry a few times and I would love to help you, but I’m not licensed to practice in Illinois. I recommend that you go to http://www.consumeradvocates.org and search for an attorney in your area. There are some good lawyers in Cook County who can help you deal with this.
One thing to remember is that you generally should not go down without a fight, and be sure that you respond to their complaint in the time allowed by Illinois procedure.
